Property & Real Estate Law

Real estate transactions and land rights require meticulous due diligence and resolute enforcement. VNS Legal Partners advises property buyers, developers, and landholders on title verification, civil suits, and RERA dispute resolution.

What We Do

Real estate transactions and land rights require meticulous due diligence and resolute enforcement. VNS Legal Partners advises property buyers, developers, and landholders on title verification, civil suits, and RERA dispute resolution.

Property law in India is characterized by intricate land revenue records, state-specific tenancy and transfer regulations, and evolving regulatory protections under the Real Estate (Regulation and Development) Act, 2016 (RERA). Whether investing in commercial land, resolving family partition disputes, or seeking remedies for delayed residential possession, property rights demand rigorous title scrutiny and assertive litigation capability.

Our chambers provide end-to-end legal support across property transactions, RERA consumer complaints, and complex civil land suits before civil courts, appellate authorities, and High Courts.

Key Legal Issues Faced by Clients

Property owners and investors face frequent legal complications:

  • Title Insecurity & Encumbrances: Unverified land titles, ancestral ownership claims, revenue entry discrepancies, and hidden encumbrances.
  • Project Delays & RERA Violations: Failure of developers to deliver possession on committed dates, unilateral alterations to layout plans, and non-refund of deposits.
  • Contentious Property Disputes: Partition suits between co-owners, boundary disputes, trespass, and suits for declaration of ownership.
  • Specific Performance: Enforcing agreements to sell when vendors refuse to execute conveyance deeds despite receipt of consideration.

Scope of Legal Services

Our property and real estate services include:

  • Conducting 30-year title searches, revenue record verification, and issuing comprehensive Title Due Diligence Reports.
  • Drafting and arguing complaints before UP RERA, Delhi RERA, and RERA Appellate Tribunals for delay interest and refund under Section 18.
  • Instituting civil suits for partition, permanent injunction, declaration of title, and mesne profits before civil courts.
  • Drafting conveyance deeds, registered sale agreements, joint development agreements (JDAs), and commercial lease deeds.

Our Methodical Approach

We believe that property protection begins with preventive diligence. By identifying encumbrances and title flaws prior to transaction execution, we shield clients from decades of civil litigation. When disputes arise, we deploy swift injunctions and statutory RERA execution mechanisms to protect property value.

Frequently Asked Questions

Q: What remedies does a homebuyer have under RERA if a project is indefinitely delayed?
Under Section 18 of RERA, if a promoter fails to give possession in accordance with the agreement for sale, the allottee has the right to withdraw from the project and claim full refund along with interest at the prescribed rate, or remain in the project and claim interest for every month of delay until possession is handed over.
